The law may provide for a minimum age for certain rights, without discrimination. For example, you must be at least 18 years old to vote or buy alcohol.

A person cannot discriminate or harass you because of your age. The Charter of Human Rights and Freedoms prohibits anyone to:

  • treat you differently because of your age
  • make offensive and repeated comments to you related to your age
  • behave repeatedly in an offensive manner towards you in relation to your age

Gilles: discriminated against at work

Gilles is 63 and has been working for the same company for the past 26 years. The manager of human resources was told to force Gilles into retirement because he is the oldest employee at the company. However, Gilles wants to continue to work for a few more years.

Gilles is productive and does all of the work he is asked to do. The company cannot require him to leave his position.
